The June 16, 2023 amendment to the Geological and Mining Law (DU 2023/2029, in force October 2023) ended the demonstration-only era: commercial storage permitted onshore, offshore and in hydrocarbon structures with EOR combination, sub-100 kt exemptions, exploration-licence replaced by approved geological-works projects, time-limited exclusive rights for complex documenters, and a National CO2 Storage Administrator taking liability under Article 39a. Transport sits in the Energy Law with direct capture-to-storage bypass of the network. Dentons (December 2024) notes the honest remainder: capture governed only by general environmental law, implementing regulations still missing, and a special comprehensive act periodically proposed. The framework turned Poland from a ban regime into a build-ready one on paper; permits and stores are the outstanding proof.
