Law 2099 of 2021 (July 10, energy transition, market dynamisation, economic reactivation) carries CCUS in three load-bearing articles: art.21 promotes green/blue hydrogen with full Ley 1715 benefits and FENOGE finance; art.22 orders the government to regulate CCUS promotion and development (definition amended by PND Law 2294/2023 art.264: large-scale capture for safe permanent storage or productive use, with MME subsurface-storage regulation for all sectors); art.57 demands objective transparent measurement methodologies guaranteeing net-zero balance for hydrogen and CCUS under the Paris NDC. The money is in art.22 par.2: income-tax discount (ET art.255), VAT exclusion (ET art.424.16), accelerated depreciation (Ley 1715 art.14) — conditioned on National GHG Reduction Registry inscription plus UPME certification. Art.24 lets ANH/ANM reconvert mining-hydrocarbon projects with CCUS. This is the binding base the draft Title VIII decree would execute.
