Texas Natural Resources Code Chapter 121 (CO2 Stewardship)
Texas Natural Resources Code Chapter 121 (originally Chapter 120, 2009 framework; redesignated 2011) vests the Railroad Commission of Texas with stewardship of anthropogenic CO2 geologic storage: the storage operator owns stored CO2 absent contract or abandonment rulings (EOR excluded), a dedicated Storage Trust Fund finances permitting, inspection, monitoring, remediation and plugging from fees and penalties, and the Commission adopts extraction-for-use rules. HB 1284 (2021) consolidated Class VI jurisdiction solely in the RRC, and 16 TAC Chapter 5 rules (2010, amended September 2022) implement the storage-facility permit, drill, completion, inspection and conversion ladder. The state applied for Class VI primacy December 19, 2022 and received it effective December 15, 2025, so the RRC now permits non-EOR storage directly while Class II EOR injection continues under Statewide Rule 46.
