Wyoming House Bill 0200 (Low-Carbon Reliable Energy Standard)

Incentive Active Verified

Wyoming House Bill 0200 (Enrolled Act 79, effective July 1, 2020) orders the Public Service Commission to set dispatchable, reliable low-carbon electricity portfolio standards (low-carbon defined as CCUS power under 650 lbs CO2/MWh) with a compliance date no later than July 1, 2030 plus intermediate milestones and IRP demonstration. It bars cost recovery for replacement generation for coal retired after January 1, 2024 unless the utility progresses toward the standard, while compliers earn CCUS cost recovery with higher return on equity (technology integral or adjacent to Wyoming coal), CO2-sale revenue sharing with shareholders, and a surcharge up to 2% of customer bills. The Commission reports biennially from 2023 on continuation, modification or repeal. A 2025 repeal bill (HB0209) passed the House 60-1 but died in Senate committee on March 3, 2025, leaving the standard in force and contested.
